To publish the Annual Equality Monitoring Report 2018-19
Proposed Decision:
St.Helens Council publishes Equality Monitoring Reports annually on its website. This Report covers the period April 2018 to March 2019. Published reports provide the evidence to demonstrate compliance with the Equality Act 2010
Summary of Reason for Decision:
To provide the evidence required to demonstrate compliance with Equality legislation.
Reason for Decision:
Published reports provide the evidence required to demonstrate compliance with Section 149 of the Equality Act 2010; the Public Sector Equality Duty, and the Equality Act 2010 (Specific Duties) Regulations 2011. Once the proposal is agreed, the Annual Equality Monitoring Report 2018-19 will be published on the Council's website.
Risks Associated with this Decision:
St.Helens Council has a responsibility to demonstrate that it has given due regard to the general duty of the Equality Act 2010. “Due regard” means a substantial, rigorous and open-minded consideration of the duty when developing or formulating policy, decisions, or service delivery arrangements (including contract specifications and funding agreement). “Due regard” requires analysis of relevant materials (including the outcomes of consultation and needs assessments). The failure to demonstrate “due regard” carries with it a risk of litigation. This can be costly.
Measures to Redress Risk:
The publication of the Annual Equality Monitoring Report provides evidence that ‘due regard’ is given within service delivery, thus demonstrating compliance and reducing the risk of exposure to litigation. The production of an Annual Equality Monitoring Report provides evidence that the Council is meeting Section 149 of the Equality Act 2010, the General Public Sector General Duty and the Equality Act 2010 (Specific Duties) Regulations 2011. To this end, the production of an Annual Equality Monitoring Report reduces the risk of failing to discharge these duties

The delivery of 'due regard' to the duties of the Equality Act 2010 support the fundamental principles of respect towards all people's individual dignity and wellbeing, which support all the 'articles' covered by the Human Rights Act 1998, but in particular: · Article 8, the right to respect for private and family life · Article 9, freedom of thought, conscience and religion · Article 12, the right to marry · Article 14, the prohibition of discrimination
