Transfer of Land Register to Land Registry and future Register Updates
Summary of Decision:
Approval of the Updates Structure
Proposed Decision:
The move to a digital Land Register, managed by Land Registry is expected to be completed by early 2019. St Helens is one of the first authorities in the country to move to this format. Attached to this decision is the agreement from Land Registry which allows the Council to share the necessary data with them. Once agreed this document will require the formal council seal. Upon completion of the migration exercise, St. Helens will no longer hold its own register however it will maintain responsibility for the upkeep of the register as part of its statutory duty. Future updating will be critical to the Council's Statutory Duty of maintaining the register. It is imperative that staff changes and service moves are reported to the Land Charges team at the earliest point,as the information these these contacts provide is essential to maintain the register. As such, attached to this decision is a spreadsheet of the most up to date contacts and the information they provide. The officers have verified that they are the correct source of the information and how this data is held. Senior officers must be aware that these arrangements need to be kept up to date or the Council will not meet its Statutory Duty.

To agree the transfer of the data and arrangements for future register updates.
Reason for Decision:
By 2022 all councils will have transferred to the central Land Register hosted by Land Registry as part of the Infrastructure Act 2016.

Officers from across the wider Council not understanding the Council's Statutory Responsiblities in respect of keeping the Register up to date.
