To approve the revised Fixed Penalty Enforcement Strategy
Proposed Decision:
To approve the revised Fixed Penalty Enforcement Strategy acknowledging the changes introduced from the previous version
Summary of Reason for Decision:
Operational reviews of the work of the service require the contents of the current strategy to be changed
Reason for Decision:
Reviews of the operational procedures have identified concerns over the fact that the same charge for Fixed Penalty Notices (FPNs) served in respect of fly tipped waste take no account of the quantity of waste deposited. A range of circumstances have been identified where it is considered inappropriate that opportunity to avoid going to court is provided to individuals through the payment of a FPN.
Risks Associated with this Decision:
Statutory guidance confirms that Local Authorities should have a Fixed Penalty Enforcement Strategy in place. Failure to do so could compromise the robustness of the legal cases taken before the Courts and subsequently cause reputational damage to the Council
