To approve the updated PRS Enforcement Policy and Penalty Charge Guidance
Proposed Decision:
To approve the updated and amended St Helens Private Rented Sector Enforcement Policy and associated Civil Penalty Guidance document to include for new legislation and Government guidance and in relation to housing enforcement.
Summary of Reason for Decision:
To ensure the Council's Housing enforcement options remain up to date and legally compliant
Reason for Decision:
The Council's Private Rented Sector Enforcement Policy and associated Civil Penalty Charge guidance provides a framework for ensuring the Council has fair and transparent processes when considering housing enforcement action. These documents are reviewed on a regular basis to ensure compliance with legislation and to take into account any relevant government guidance. The emergence of additional housing legal powers is reviewed by the Council's Housing and Legal services to ensure that the Council's processes remain up to date and that all appropriate enforcement options can therefore be considered and implemented as necessary by the Council's Housing Enforcement team. The Council's Legal services have confirmed that the amendment of the Enforcement Policy and associated Civil Penalty Guidance to include for legislative updates does not materially change the Policy and that approval via Delegateed Executive Decision is appropriate. The proposed amendments will support the Council to provide effective advice and assistance to both tenants and landlords, enabling improved housing standards across the private rented sector.

Failure to include appropriate enforcement legislation and processes within the Council's published policies will restrict enforcement options available or lead to legal challenge if used incorrectly.
